Re: Raw Milk issue, Agenda #65, February 6, 2001.
PETITION FOR TIME
We address two issues herein. We request/demand that is letter be entered into and made part of the record in the Raw Milk issue before the Los Angeles County Board of Supervisors (“Board”).
Firstly, the Report generated by the Los Angeles County Department of Health Services (Department) lacks thorough research and displays prejudice against raw milk. In order that the record be thorough and unbiased we, the petitioners for raw milk, are undergoing research and collection of data that will make a fair appraisal of the raw milk issue possible for the Board before its vote on this issue. Therefore, we request/demand that the Board delay its vote on the raw-milk issue for 30 days. The vote is presently scheduled for February 6, 2001, Agenda item #65. Please notify us by written response to Arlene Binder, Attorney at Law at the address above, as to the date to which the issue will appear following the 30-day allowance for a completed report from petitioners.
Secondly, we understand there is currently a rumor promoted by the Department that the people involved in petitioning for Grade A and Guaranteed raw milk are "dangerous". A journalist from the LA Times asked one of the petitioners, Aajonus Vonderplanitz, what his response was to the Departments’ statements that he was dangerous because of his choice of cuisine. (His response is included in this letter as Exhibit A; please read it in its entirety and include it in the official file. Thank you.) The rumor that he is dangerous is without scientific basis. What is dangerous is opinion-based policy whereby judging a worldwide existing cuisine-tradition of drinking raw milk and eating raw steak and raw fish tartar, sushi, sashimi, carpaccio, kibbie and cerviche is characterized as being "dangerous". This shows a lack of culinary knowledge within the Department. Evaluating a person’s cultural food and health preference as "dangerous" is immoral and defamation of character. Is this part of a strategy for denying our petition? Defaming people who are protecting their right to diversity in cuisine and health opens this issue to an unnecessarily explosive situation, and opens a precedent of "opinion as law".
We ask the Department and the Board of Supervisors to accept food preferences and cultural diversity, not as a matter related to health only but for the great enjoyment of food. You cannot characterize any petitioners’ efforts as "dangerous" without it being slanderous. Consider the following State legislation: From suggested legislation from the California Department of Health Services’ concerns over bacterial food-poisoning, California State Assembly Bill 2612 was passed in January 1998. This bill legislated that all ready-made meat and eggs be cooked to well-done. After becoming law, the legislature realized that they had legislated against a wide range of cultural cuisine, including Caesar Salad that contains raw egg in its dressing. In June of 1998 the law was rewritten to allow the cultural diversity in cuisine by: NOTIFICATION of the patron that a raw food is in the dish, or PATRON REQUEST that their food be prepared less than well-done, including raw. The state legislation mentioned above allows for this diversity in preferences, affecting children as well as adults. This California State legislation considered the implications to children, allowing them and their parents to eat raw flesh-food that may contain “pathogenic” bacteria.
If you vote against the petitioners and legislate law as the State did in AB2612, you will make the same mistake that the State Legislature did. This would make it a very "dangerous" precedent of the City ruling and dispensing law independently as an entity above the State. This is not in the Board’s best interest, not in your jurisdiction, and certainly not one of merely conforming code ordinances.
If slander and defamation is a strategy to disagree with our petition, it does not show goodwill towards the people. We ask you to immediately instruct your personnel in the Department to be more considerate and aware of food cultural diversity and the rights related to such cuisine preferences whether it is religious, secular, or health. There is nothing "dangerous" about people wanting to drink raw milk from the cow with its nutritious enzymes, vitamins, proteins, fats, and natural “pathogen”-neutralizing substances unaltered by man's intervention. It is not a menace to society as members of the Department have implied with the label “dangerous”.
Is the Department ready to call Mel Gibson, James Brolin, Kathy Lenon (of the Lenon sisters), Frankie Laine (the singer), Laura Dern, and many more celebrities who have healed themselves with the help of raw food “dangerous”? Mel Gibson has publicly stated that his good health has been achieved with the consumption of a raw diet, including raw meat. He has 6 children. The Department and Board have incomplete scientific data on this subject, so their opinion and prejudice that raw food, including raw milk and raw meat, are dangerous to the well-being of adults and children is invalid. Are the Department and Board going to call Mel Gibson “dangerous” because his children are exposed to eating raw milk and raw meat?
The Board is in danger of erring and abusing its discretion because of the lack of unbiased research and opinion generated by the Department’s Report and rumor. We request/demand 30 days to issue to the Board a very comprehensive scientific evaluation with documentation on the merits of raw milk and the ill-health results of pasteurized milk.
We remain, respectfully,
Arlene Binder, Attorney
at Law
Roger Noorthoek, Attorney at Law
And the 81 Petitioners in favor of Grade A and Guaranteed raw milk who appeared before the Board on the issue on December 19, 2000.

LACDHS Personnel Call Petitioner Dangerous
Aajonus Vonderplanitz’ answer to the question posed by an LA Times reporter, “The health departments call you dangerous, how do you respond to that?”:
The Health Services personnel and people in the medical establishment view microbes as the cause of disease rather than merely a symptom and stage-of-cure for disease, as I do. As long as medically founded health departments remain germ-phobic, anyone who sees their great enemy microbes as allies will receive their scorn. The fact is, the germ-theory is speculation and has never been proved in their fields. However, with over 2,000 of the medically labeled "infirm" eating raw meat and drinking raw milk since 1977, I have witnessed only a rare case of diarrhea or vomiting, which occurs on any diet. I am a person they consider infirm. For treatment of a duodenal ulcer that turned tumorous at age 19, a medical doctor performed a vagotomy on me, severing all of the vagus nerves to my stomach. I have not produced hydrochloric acid since then, November 27, 1967, in Beverly Hospital, Montebello, CA. I was told that I was in danger of death from bacterial and parasitic invasions in raw food. I was instructed by the doctors never to eat raw food again or it would sooner than later kill me. However, exclusively eating raw foods, of which 95% is raw animal matter, I completely reversed 7 "incurable" diseases: Multiple Myeloma (cancers of the blood and bone, considered one disease), cancers of the stomach and lymph, juvenile diabetes, psoriasis, bursitis and angina pectoris.
Who in the medical profession has observed people who ate a diet of raw animal matter? None. I have not found one controlled test in all of the research in the USA. A few anthropologists and Dr. Weston Price have observed the Masai, Samburu and Inuit tribes. They documented that as long as those tribes continued their raw animal-consumption diets they suffered no degenerative disease, not even cavities.
According to the LACDHS’s recent report on raw milk, raw
milk has not caused one single death, or maiming or prolonged illness in
California even though raw milk was consumed for centuries without the present
over-restrictive regulations imposed in 1990s, especially those imposed since
1998. My analogy of the
medically-established-health-department officials calling me dangerous is like
the pot calling the clean plate black. According
to the Journal of the American Medical Association, conventional medicine kills
225,000 Americans per year. That includes 106,000 (about 300 per day) from
properly prescribed and properly administrated medications, including deaths to
children from vaccines; 7,000 from medical errors in hospitals; 20,000 from
other hospital errors; and 80,000 from infections acquired while in the hospital
(JAMA 2000). Conventional medicine injures over 2 million Americans per year
severely enough to require hospitalization (JAMA 1998).
In addition, over the counter drugs kill another 16,000 Americans per
year. (JAMA 1998). I have to say
that they have proved to be dangerous, I have not.
