The Fifth Amendment Wins Again

Recently, the Ninth Circuit Court of Appeals affirmed what you and I have known all along about the Fifth Amendment. It does apply to tax returns. Can you believe that I was sanctioned $6,000 for arguing in the Tenth Circuit that the 5^th Amendment applies to tax returns? It is absolutely amazing that the Department of Justice actually put the Circuit Court of Appeals in the position of having to answer a question like this one. Well, the Ninth Circuit did us a great favor and the decision, although it does not create any new law, makes it very, very clear that individuals do have a right to be concerned about waiving their Fifth Amendment Rights when answering questions that pertain to their tax liability. The court’s opinion has been quoted in full in this newsletter because this case is so important.
